Terms and conditions
This is an English reading version. The German text of this page is the legally binding one.
1. Scope
These terms apply to all tuition contracts between Lernnest Heepen GbR, Salzufler Straße 41, 33719 Bielefeld ("Lernnest") and the parent or legal guardian who enrols a child ("the customer"). Deviating terms of the customer do not apply unless we agree to them in writing.
2. Formation of contract
An enquiry through this website is not a booking. A contract comes into existence when we confirm a place in writing, by email or on paper, and the customer countersigns the enrolment form. The customer confirms on enrolment that they hold parental responsibility for the child.
3. Services
Lernnest provides tuition in small groups at the times booked, during the school term of North Rhine-Westphalia. Group sizes are as stated on this website: a maximum of five learners in the primary groups, four in the secondary maths groups, three in the Q1–Q2 group and eight in the supervised study room. Lernnest owes the careful provision of tuition, not any particular grade, mark or examination result. Any statement about outcomes is expressly not a guarantee.
4. Fees and payment
Fees are those published on this website: €69 per month for the primary reading and maths group, €89 per month for secondary maths, €139 per month for the sibling bundle covering two children of one household, and €25 per evening for the parent workshop. Fees are due monthly in advance and are collected by SEPA direct debit on the third working day of the month. They are exempt from VAT under § 4 no. 21 lit. a) bb) UStG. There is no registration fee and no separate charge for materials. Fees are payable in full for months containing school holidays, since the monthly fee already reflects the term-time timetable.
5. Missed sessions
A session missed by the learner is not refunded. Where the customer tells us in advance, we offer a place in the same group on another day in the same week if a chair is free. If Lernnest cancels a session, it is made up in the following four weeks or the fee for it is credited.
6. Term and notice
The contract runs for an indefinite period. Either party may terminate it with one month's notice to the end of a calendar month, in text form, without giving reasons. There is no minimum term and no automatic extension. The right of both parties to terminate for good cause remains unaffected.
7. Right of withdrawal
A customer who is a consumer and concludes the contract exclusively by distance communication has a right to withdraw within fourteen days without giving reasons, by an unambiguous statement sent to hallo@lernnest-heepen.de. Where tuition has already begun at the customer's express request, reasonable payment for the sessions already provided is due.
8. Duty of care and collection
Lernnest supervises learners on the premises during the booked times only. The customer states on the enrolment form whether the child may leave alone at the end of a session and, if not, who may collect them. Lernnest is not responsible for the journey to and from the centre.
9. Liability
Lernnest is liable without limitation for injury to life, body or health and for intent and gross negligence. In the case of slight negligence, liability is limited to the breach of essential contractual obligations and to the foreseeable damage typical of this kind of contract. Liability for items brought onto the premises is excluded except in cases of intent or gross negligence.
10. Data protection
Personal data is processed as described in our privacy policy. Data concerning a child is processed on the basis of the parental consent given on enrolment and is limited to what is described there.
11. Final provisions
German law applies, with the mandatory consumer protection provisions of the customer's country of residence remaining unaffected. Should a provision be or become invalid, the remainder of the contract stays in force. Bielefeld is the place of performance.
